The Software Updates and Maintenance clause in software license agreements or software as a service agreement defines the licensor's obligation to provide fixes and updates to the software application.

Clause elements

  • Fixes and patches (to cure errors and usage issues)
  • Upgrades (or updates) to the functionality of the software

Note: ContractStandards draws a distinction between support and maintenance: support is assistance to users on how to operate the software; whereas maintenance covers fixes and upgrades to the software application. In the case of software installed under a license agreement, maintenance services may require delivery and installation of software patches on the licensee's computer platform.
